Affiliate Referral Program Terms

> Not legal advice. Working draft of the terms governing CRMish's own referral program — i.e., the program by which existing CRMish users can refer new customers in exchange for compensation. The program is not yet active. This document is published as a placeholder so the terms exist when the program launches, and so prospective referral partners can review them in advance. > > Important: This document is not about how you, the user, manage your own affiliate business inside CRMish. CRMish is a tool you use to run your affiliate work. The terms below are about a separate program where you refer new CRMish customers to us.

1. Program overview

The CRMish Affiliate Referral Program ("Program") is operated by JAS Operations LLC dba CRMish. The Program allows approved Participants to earn referral compensation by introducing new paying customers to CRMish.

These Affiliate Referral Program Terms ("Affiliate Terms") govern your participation. They form part of, and are subject to, the Terms of Service and Privacy Policy.

2. Eligibility

To join the Program you must:

  • Be at least 18 years old.
  • Have an active CRMish account in good standing.
  • Comply with these Affiliate Terms, the Terms of Service, and applicable law.
  • Be able to lawfully receive payment from a U.S. company in your jurisdiction (we will collect tax information at payout time).

We may refuse, suspend, or revoke Program eligibility at our discretion.

3. Application and approval

The Program may be open to all eligible users or limited by invitation, at our discretion. Participation requires:

1. Application from inside the Service (or via a designated form). 2. Acceptance of these Affiliate Terms. 3. Approval from CRMish.

We may decline applications without explanation.

4. Referral mechanics

4.1 Tracking link

On approval, you receive a unique referral link tied to your CRMish account. When a prospective customer clicks the link and subsequently signs up for a paid CRMish plan within a documented attribution window (currently 60 days after first click), the conversion is attributed to you.

4.2 Attribution rules

  • First-touch attribution. The first Participant's link clicked by the prospect within the attribution window receives credit.
  • Self-referrals are not permitted. Signing up new accounts through your own link does not earn compensation. Accounts found to be self-referred will be disqualified and any compensation will be reversed.
  • Existing customers are not eligible for re-acquisition compensation. The prospect must be a net-new paying customer who has not previously held a paid plan.
  • Refunded customers do not earn referral compensation. If the customer requests a refund within the first billing period, the corresponding referral compensation is reversed.

4.3 Compensation

The compensation tier(s) (one-time payment per conversion, percentage of first year, percentage of lifetime, credit toward your own subscription, etc.) will be published on the Program enrollment page when the Program launches. Compensation tiers may change with notice; existing earned compensation is not retroactively reduced.

4.4 Payment

  • Payments are made via Stripe Connect or equivalent payout processor, in U.S. dollars unless otherwise specified.
  • Payments are issued on a schedule (currently planned: monthly, for amounts above a $50 minimum threshold). Amounts below the threshold roll over.
  • You are responsible for any taxes, fees, or compliance with your local laws relating to your receipt of compensation.
  • We may withhold or report compensation as required by U.S. tax law (e.g., issue a Form 1099-NEC if your annual compensation exceeds the IRS reporting threshold).

5. Acceptable promotion

You agree to promote CRMish honestly and in compliance with law and Program rules.

5.1 You may

  • Promote CRMish on your website, blog, podcast, newsletter, social media, or to your private audience.
  • Use CRMish-provided marketing materials (logos, screenshots, copy) as published in the Program brand-kit.
  • Run paid advertising on platforms that allow third-party affiliate promotion for SaaS products, subject to §5.2.
  • Make truthful claims about CRMish and your experience with it.

5.2 You may not

  • Bid on CRMish's brand keywords (e.g., "CRMish", "Grupo JAS", "Beck") on Google Ads, Bing Ads, or any other paid-search platform without our prior written permission.
  • Run paid ads that target CRMish customers searching for support, billing, or other branded terms.
  • Use deceptive headlines, fake reviews, fake testimonials, or fake screenshots.
  • Misrepresent your relationship to CRMish — you are an independent Participant, not an employee, agent, or representative of CRMish.
  • Send unsolicited commercial email, SMS, or DMs promoting CRMish in violation of CAN-SPAM, TCPA, CASL, GDPR (PECR), or other applicable law. See our Anti-Spam Policy.
  • Distribute discount codes, coupons, or loyalty offers not authorized by CRMish.
  • Promote CRMish using content that infringes a third party's intellectual property, defames any person, or contains adult, hateful, or illegal material.
  • Register or use domain names, social handles, or app names that are confusingly similar to CRMish's brand.
  • Use CRMish's name or logo on materials promoting a different product or service.
  • Earn compensation by enrolling accounts that you control, your immediate family controls, or that are controlled by entities you have an interest in.

5.3 Required disclosures

You must comply with applicable affiliate-disclosure law, including the U.S. Federal Trade Commission's "Endorsement Guides." In practice this means clearly and conspicuously disclosing your material connection to CRMish wherever you promote it (e.g., "I receive a referral fee if you sign up through this link").

6. Term and termination

These Affiliate Terms begin when CRMish approves your application and continue until terminated.

6.1 By you

You may leave the Program at any time by notifying CRMish at affiliates@crmish.io. Earned compensation through the date of termination remains payable, subject to standard validation (no refunded conversions, etc.).

6.2 By us

We may terminate or suspend your participation:

  • For violation of these Affiliate Terms, the Terms of Service, the Acceptable Use Policy, or law.
  • For brand-protection reasons.
  • For business convenience, with reasonable notice.

If we terminate for cause, unpaid compensation may be forfeited.

6.3 Program changes or end

We may modify or discontinue the Program at any time with reasonable notice. Earned compensation through the announced end date remains payable subject to validation.

7. Confidentiality

Non-public information about the Program (commission tiers, attribution windows, internal performance data, planned changes) is confidential. Do not share it without our written permission.

8. Independent contractor

You are an independent contractor. The Affiliate Terms do not create any agency, partnership, joint venture, or employment relationship between you and CRMish. You have no authority to bind CRMish or to make representations on CRMish's behalf.

9. Indemnification

You will indemnify, defend, and hold harmless CRMish and our affiliates from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of your promotion of CRMish or your breach of these Affiliate Terms.

10. No exclusivity

You may promote competing products. We may engage other affiliate Participants. Neither side owes the other exclusivity.

11. Disclaimer; limitation of liability

The Program is provided on an "as is" basis. CRMish makes no warranty regarding conversion rates, traffic quality, or compensation amounts. The limitation of liability in Terms of Service §16 applies to the Program.

12. Governing law and disputes

Same as the Terms of Service §18–§19.

13. Changes to these Affiliate Terms

We may update these Affiliate Terms. Material changes are posted here and notified to active Participants by email. Continued participation after the change date constitutes acceptance.
